Judgment text excerpt

The Supreme Court held that the Karnataka High Court erred in quashing the investigation under Section 482 of the Code of Criminal Procedure, 1973, regarding the respondent accused of offences under Section 13(1)(e) and Section 13(2) of the Prevention of Corruption Act, 1988. The Court emphasized that the High Court's findings on inordinate delay and lack of reasons for the investigation authorization were incorrect, as the delay was partly due to the respondent's actions and reasons were indeed provided by the Superintendent of Police. The Court reinstated the investigation proceedings, allowing the prosecution to act on the facts afresh.
