The Supreme Court held that under Section 7 and Section 13(2) read with Section 13(1)(d) of the Prevention of Corruption Act, the appellant, convicted and sentenced to two years and three years of rigorous imprisonment respectively, is entitled to bail during the pendency of the appeal. The Court emphasized that for sentences of three years or less, bail should ordinarily be granted due to the prolonged nature of appellate proceedings. The interim bail granted earlier was made absolute until the High Court decides the appeal.
