The Supreme Court held that the Kerala High Court erred in declaring the election of the appellant void on the grounds that he did not subscribe to an oath before an authorized officer and that his nomination papers were improperly accepted. The Court found that the Assistant Returning Officer, despite lacking formal authority, acted in a de facto capacity, thus validating the election process under the Kerala Panchayat Raj Act, 1994. The appeal was allowed, reinstating the election of the appellant as valid.
