Judgment text excerpt
The Supreme Court held that M/s. Holani Auto Links Pvt. Ltd. qualifies as a 'Dealer' under Clause 2(a) of the M.P. Essential Commodities (Exhibition of Price & Price Control) Order, 1977, thereby affirming the Collector's order for confiscation of goods under Section 6(a) of the Essential Commodities Act, 1955. The Court found that the High Court correctly set aside the Sessions Judge's ruling which had previously exempted the appellant from the definition of 'Dealer'. Consequently, the appeal was dismissed, upholding the High Court's decision.
