Judgment text excerpt

The Supreme Court upheld the Madras High Court's ruling that Saraswathi Ammal had absolute title to the property sold to Anna Pushpam Ammal and Lalitha Ammal, despite the appellant's claim based on an earlier agreement for sale. The Court clarified that the application to implead Saraswathi Ammal did not retroactively affect the validity of her subsequent sales under Section 52 of the Transfer of Property Act, 1882. The Court affirmed that the principles of lis pendens did not apply, and thus the plaintiffs acquired absolute title through their vendors.
