Judgment text excerpt

The Supreme Court addressed the entitlement of claimants for benefits under Sections 23(1-A), 23(2), and 28 of the Land Acquisition Act, 1894. The Court held that while benefits under Section 23(1-A) may not be available as per K.S. Paripoornan v. State of Kerala, the benefits under Sections 23(2) and 28 are applicable as established in Union of India v. Raghubir Singh and K.S. Paripoornan v. State of Kerala (1995). The appeals were allowed, affirming the applicability of enhanced solatium for awards made within specified periods under the Act.
