The Supreme Court held that an ad hoc appointee, such as the respondent who was appointed as a Stenographer for a limited period, does not have a right to continue in service after failing a qualifying test. Citing the precedent in State of U.P. v. Kaushal Kishore, (1991) 1 SCC 691, the Court emphasized that temporary employees lack a legal right to the post and should not be allowed to continue in public interest. Consequently, the Court set aside the orders of the High Court, allowing the appeal filed by the State.
