The Supreme Court, in a transfer petition under Section 13 of the Hindu Marriage Act, held that the petitioner-wife, currently residing with her parents in Dahod, Gujarat, could not adequately defend her case in Ratlam, Madhya Pradesh. The Court found sufficient grounds for the transfer of the divorce proceedings from the ADJ IV, Ratlam to a competent court in Dahod. Consequently, the transfer petition was allowed, and all records were ordered to be transmitted accordingly.
