The Supreme Court examined whether M/s. Holani Auto Links Pvt. Ltd. qualifies as a 'Dealer' under Clause 2(a) of the M.P. Essential Commodities (Exhibition of Price & Price Control) Order, 1977. The Court held that the appellant company, being a distributor and not a dealer, was not liable for the alleged violations of Clauses 3(1) to 3(3) and 6(1) of the Order of 1977. Consequently, the Court set aside the High Court's order and reinstated the Sessions Judge's decision, thereby favoring the appellant company.
