The Supreme Court held that the transaction value of goods sold by Bharti Telecom Ltd. (BTL) to Siemens Telecom Ltd. (STL) should be accepted as it was at or about the same price as sold to the Department of Telecommunications (DOT) and Mahanagar Telephone Nigam Limited (MTNL). The court found no merit in the Revenue's claim that BTL and STL were related persons influencing the price, and the issue of clandestine removal of goods was rendered moot as the proceedings were dropped. Consequently, the appeals were dismissed with costs.
