Judgment text excerpt
The Supreme Court addressed the status of the Institute of Engineering and Rural Technology (IERT) in relation to the Uttar Pradesh Absorption of Retrenched Employees of Government/Corporations in Government Service Rules, 1991. The Court held that IERT is not an instrumentality of the State, thus the Absorption Rules do not apply to its employees. The judgment of the Allahabad High Court was upheld, confirming that retrenched employees who accepted compensation could not challenge the closure of IERT.
