The Supreme Court upheld the Allahabad High Court's decision allowing the writ petition challenging the Moradabad Development Authority's demand for development charges under the Urban Land (Ceiling and Regulation) Act, 1976. The Court found that the State Government's order dated 9.7.1998, which declared the land as agricultural and outside the Act's purview, was binding, and thus the appellant's claim for charges was illegal. The Court directed the restoration of possession of the land to the respondents without any development charges imposed by the appellant authority.
