Moradabad Development Authority vs Saurabh Jain And Ors

The Supreme Court upheld the Allahabad High Court's decision allowing the writ petition challenging the orders of the Moradabad Development Authority regarding the possession of land under the Urban Land (Ceiling and Regulation) Act, 1976. The Court found that the demand for development charges by the appellant authority was illegal and arbitrary, as the land had been declared agricultural and outside the purview of the Act by the State Government. Consequently, the Court directed the return of possession of the land measuring 4511 sq. mtrs. to the respondents without any development charges.
