The Supreme Court held that the Bureau of Indian Standards (BIS) must promote its scientists in accordance with the Flexible Complementing Scheme (FCS) and the relevant provisions of Regulation 9 of the Bureau of Indian Standards (Recruitment to Scientific Cadre) Regulation, 1988. The Court emphasized that the delay in promotion, which was attributed to changes in service regulations, was unjustified as the respondents were entitled to promotion after completing the requisite residency period. The Court upheld the decision of the Delhi High Court, thereby affirming the promotion of the respondents to the post of Scientist-D effective from the date of their eligibility.
