Judgment text excerpt
The Supreme Court held that the principle of equal pay for equal work cannot be applied unless there is a complete and wholesale identity between the two groups, as established in S.C. Chandra vs. State of Jharkhand. The Court emphasized that fixing pay scales is an executive function and should not be determined by the judiciary. Consequently, the Court set aside the judgments of the Gauhati High Court and the Central Administrative Tribunal, allowing the appeal and denying parity in pay scales for Senior Auditors and Assistants in the Central Secretariat.
