The Supreme Court ruled that the appellants, who were appointed as Supervisor Grade-A, were entitled to take an examination for promotion to Chargeman Grade-II as per the amended Scheme dated 4th May 1967. The Court held that the failure to grant them this opportunity constituted discrimination, violating principles of fair treatment in public employment under Article 14 of the Constitution. The Court directed the authorities to refix the notional seniority and pay scale of the appellants based on their successful performance in the selection test, without any back wages.
