The Supreme Court held that the benefit of age relaxation under the Office Memorandum dated 9.4.1981 cannot be extended to Dr. Jai Dev Wig and Dr. M.S. Sekhon, as they are not considered Government servants under Article 311 of the Constitution. The Court found that the Post Graduate Institute is an autonomous body and the respondents' services do not fall under the provisions of Article 309. Consequently, the High Court's ruling granting them age relaxation was set aside, and the appeals were allowed.
