The Supreme Court, in this arbitration application under Sections 11(5), 11(10), and 11(12) of the Arbitration and Conciliation Act, 1996, held that the applicant, Citibank, is entitled to the appointment of a sole arbitrator to resolve disputes arising from a tripartite agreement with respondents TLC Marketing PLC and Wunderman India Pvt. Ltd. The Court found that the respondents are alter egos with joint and several obligations under the agreement, which was operational from October 1, 2005, to August 31, 2006. The application was granted, leading to the appointment of an arbitrator for the international commercial arbitration.
