The Supreme Court held that the Bureau of Indian Standards (BIS) must adhere to the provisions of Regulation 9 of the Bureau of Indian Standards (Recruitment to Scientific Cadre) Regulation, 1988, which mandates promotion based on a defined assessment procedure. The Court found that the delay in promoting the respondents from Scientist-C to Scientist-D, despite their eligibility, was unjustified and violated the principles of the Flexible Complementing Scheme (FCS). Consequently, the Court upheld the High Court's decision to direct BIS to promote the respondents effective from their due date in 1999, thereby reinforcing the statutory obligations under the Bureau of Indian Standards Act, 1986.
