Judgment text excerpt

The Supreme Court held that retrospective promotion does not entitle an employee to arrears of salary under the principle of 'no work no pay'. Citing the cases of State of Haryana & Ors. v. D.P. Gupta & Ors. [1996] 7 SCC 533 and A.K. Soumini v. State Bank of Travancore JT (2003) 8 SC 35, the Court emphasized that an employee must have worked in the promotional post to claim such benefits. The Court set aside the High Court's order affirming the Central Administrative Tribunal's decision, thereby allowing the appeal.
