Judgment text excerpt
The Supreme Court held that the principle of equal pay for equal work cannot be applied unless there is a complete and wholesale identity between the two groups, as established in S.C. Chandra vs. State of Jharkhand (JT 2007(10)4 SC 272). The Court emphasized that fixing pay scales is an executive function, and the judiciary must refrain from encroaching on this domain. Consequently, the appeal was allowed, setting aside the judgments of the Gauhati High Court and the Central Administrative Tribunal, with no order as to costs.
