The Supreme Court upheld the provisions of the Pepsu Village Common Lands Act, 1954 and the Punjab Village Common Lands Act, 1961, specifically Section 4 and Section 443, which protect the rights of mortgagees in possession of Shamlat Deh land. The Court ruled that the Gram Panchayat could not disturb the possession of the legal representatives of Moola, as they had been in possession for over 30 years, thus losing the right of redemption. The appeal against the High Court's dismissal of the regular second appeal was dismissed, affirming the lower courts' decisions.
