The Supreme Court upheld the conviction of the accused under Section 18 of the Narcotics Drugs and Psychotropic Substances Act, 1985, for possession of 45 Kgs of poppy straw powder. The Court reiterated that the minimum sentence for such an offence is ten years of rigorous imprisonment and a fine of Rs. 1 lakh, with no discretion for the trial court in sentencing. The High Court's decision to restrict the sentence to the period already undergone was found to be inappropriate, leading to the appeal being allowed and the original sentence reinstated.
