The Supreme Court held that the respondents, Dr. Jai Dev Wig and Dr. M.S. Sekhon, are not entitled to the age relaxation benefits under the Office Memorandum dated 9.4.1981, as they do not qualify as Government servants under Article 311 of the Constitution of India. The Court found that the Post Graduate Institute is an autonomous body and the services of the respondents are not covered by the relevant constitutional provisions. Consequently, the orders of the High Court and the Tribunal granting such benefits were set aside, affirming that the relaxation cannot be legally extended to them.
