Judgment text excerpt

The Supreme Court upheld the decision of the Patna High Court, affirming that the GAMS degree obtained by the petitioners was not valid for admission to the Post Graduate Course in Ayurved due to non-recognition by the Central Council of Indian Medicine (CCIM) under the Indian Medicine Central Council Act, 1970. The Court emphasized that only degrees conferred by institutions following the BAMS course as prescribed by CCIM are valid, and the provisions of the Bihar Indigenous Medical Educational Institution (Regulation and Control) Act, 1982, further regulate the recognition of such degrees. Consequently, the petitioners were denied the right to appear for the examination as their degrees were obtained from institutions not compliant with the statutory requirements.
