The Supreme Court upheld the validity of the Constitution (Scheduled Caste) Orders 2nd Amendment 2002, which excluded the 'Mochis' outside the Dang District and Umargaon Taluka of Valsad District from the Scheduled Caste list under Article 341 of the Constitution. The Court ruled that the President has the authority to specify castes as Scheduled Castes and that such notifications cannot be varied by subsequent notifications. The Court emphasized that the legislative power under Article 341(2) is not plenary and should not be subject to wider judicial review.
