The Supreme Court examined whether Clause 4 of Work Order No.114 constituted an arbitration agreement under Section 2(a) of the Arbitration Act, 1940. The Court held that the clause indeed constituted an arbitration agreement, affirming the decision of the Additional Senior Subordinate Judge, Ropar, which had allowed the appointment of an arbitrator. The Court also ruled that the application for arbitration was filed within the limitation period as per Article 137 of the Limitation Act, 1963, thereby restoring the earlier order of the subordinate judge.
