Judgment text excerpt

The Supreme Court held that an application under Section 14(2) of the Arbitration and Conciliation Act, 1996, for terminating the mandate of an arbitrator must be filed before the Principal Civil Court, which includes the High Court exercising original civil jurisdiction, and not before the Supreme Court. The Court clarified that it had no jurisdiction to entertain such applications as it did not retain jurisdiction under the 1996 Act, unlike the previous 1940 Act. Consequently, the petition was deemed not maintainable and was dismissed.
