The Supreme Court held that Clause 4 of Work Order No.114 constituted an arbitration agreement under Section 2(a) of the Arbitration Act, 1940. The Court affirmed the decision of the Additional Senior Subordinate Judge, Ropar, which had found that the application for appointment of an arbitrator was filed within the limitation period as per Article 137 of the Limitation Act, 1963. Consequently, the Court restored the order of the High Court, allowing the reference of the dispute to arbitration.
