Judgment text excerpt
The Supreme Court addressed the conflict between the Institute of Chartered Financial Analysts of India and the Institute of Chartered Accountants of India regarding the use of the designation 'Chartered Financial Analyst'. The Court held that the actions of the Institute of Chartered Accountants, which sought to restrict the use of the designation based on an opinion from the Additional Solicitor General, were not supported by any initiated investigation under Sections 11 and 36 of the Monopolies and Restrictive Trade Practices Act, 1969. Consequently, the Court ruled in favor of the appellant, allowing the use of the designation by the Institute of Chartered Financial Analysts of India.
