The Supreme Court held that the respondent, Suresh Ramkrishna Burde, was wrongfully appointed to a position reserved for Scheduled Tribes based on a false caste certificate, which was invalidated by the Scrutiny Committee under the Maharashtra Scheduled Castes, Scheduled Tribes, De-notified Tribes (Vimukta Jatis), Nomadic Tribes and Other Backward Classes (Regulation of Issuance of Caste Certificate) Act, 2000. The Court emphasized that the principle established in State of Maharashtra vs. Milind (2001) 1 SCC 4 regarding the verification of caste certificates must be adhered to, and upheld the High Court's order for reinstatement without benefits of the reserved category. The appeal was dismissed, affirming the High Court's decision.
