Judgment text excerpt

The Supreme Court addressed the issue of territorial jurisdiction under Section 181(2) of the Code of Criminal Procedure, ruling that the trial for the abduction case involving Ravi Varshney should be conducted in the Sessions Court of Lucknow or Unnao, Uttar Pradesh, as the offence was committed there despite some communications occurring in Nainital. The Court upheld the Additional Sessions Judge's finding that mere receipt of ransom calls in Nainital does not establish jurisdiction for trial there. The High Court's order setting aside the Additional Sessions Judge's ruling was thus overturned, affirming the proper jurisdiction for the trial.
