Judgment text excerpt

The Supreme Court held that the Allahabad High Court exceeded its jurisdiction in cancelling leases and ordering demolition of constructions under the Uttar Pradesh Parks, Playgrounds and Open Spaces (Preservation and Regulation) Act, 1975 and the Uttar Pradesh Urban Planning and Development Act, 1973. The Court found that the original writ petition did not challenge the leases granted to the appellants, nor did it address unauthorized constructions related to them. Consequently, the directions issued by the High Court were set aside, affirming the validity of the leases and constructions made by the appellants.
