The Supreme Court addressed the interpretation of Section 50(4) of the Wild Life (Protection) Act, 1972 and the applicability of Section 457 of the Code of Criminal Procedure, 1973. The Court held that the deletion of sub-section (2) of Section 50 does not affect the Magistrate's jurisdiction to release seized property, as the property does not automatically become government property without a determination of its use in an offence under Section 39 of the Act. The High Court's ruling affirming the Magistrate's jurisdiction was upheld, allowing the release of the tractor trolley seized from the respondent's brother.
