Judgment text excerpt

The Supreme Court held that the Bombay High Court erred in dismissing the writ petition concerning a contractual dispute between two public sector undertakings, namely the City & Industrial Development Corporation of Maharashtra Limited (CIDCO) and the appellant. The Court emphasized that writ jurisdiction can be exercised in contractual matters under certain circumstances, as established in Whirlpool Corporation v. Registrar of Trade Marks, Mumbai (1998 (8) SCC 1). The appeal was allowed, and the matter was remanded for consideration in light of the principles laid down regarding maintainability of writ petitions in contractual disputes.
