The Supreme Court addressed the appeal of Navjot Singh Sidhu, who was convicted under Section 304 Part II IPC and sentenced to 3 years R.I. by the High Court after being acquitted by the Sessions Judge. The Court examined the implications of Section 8(3) and (4) of the Representation of the People Act, 1951, which disqualifies a convicted individual from being a member of Parliament. The Court held that the disqualification would not take effect until three months from the date of conviction or until the appeal is disposed of, thus allowing Sidhu to seek suspension of his conviction pending appeal.
