The Supreme Court held that the termination of the respondent's services by the Punjab State Electricity Board was invalid as it relied on a decision concerning another employee without conducting a proper departmental proceeding to prove the charge of fraud under Article 142 of the Constitution of India. The Court directed the Board to initiate a departmental inquiry against the respondent while setting aside both the termination order and the earlier order of the Administrative Member. The appeal was allowed, reinstating the respondent with the possibility of suspension and requiring the Board to refund deducted salary.
