The Court clarified that the exemption notification was a prerequisite for the tender process, and the failure to furnish the bank guarantee did not invalidate the tender acceptance. Consequently, the appeal by M/s Puravankara Projects Ltd. was dismissed, maintaining the status of the successful bidder, Venus.
