Judgment text excerpt
The Supreme Court upheld the Allahabad High Court's dismissal of a writ petition seeking a Central Bureau of Investigation (CBI) inquiry into the death of Major S. Ravishankar, concluding that an aggrieved person cannot insist on a specific investigative agency as per the precedent set in CBI & another vs. Rajesh Gandhi (1997 Cr.L.J 63). The Court reiterated that the right of an aggrieved person is to ensure proper investigation, not to dictate the agency. The appeal was dismissed, affirming the findings of the Army's Courts of Inquiry that ruled the death a suicide.
