Judgment text excerpt

The Supreme Court upheld the dismissal of a second appeal under Section 100 CPC regarding the cancellation of a sale deed executed by Raghoram, who had not obtained Bhumidhari rights before his death. The Court interpreted Sections 134 and 137 of the U.P. Zamidari Abolition and Lands Reforms Act, 1950, concluding that the grant of Bhumidhari rights does not relate back to the date of deposit of 20 times rent if the tenant dies before the issuance of the Sanad. Consequently, the appeal was dismissed, affirming the lower courts' decisions.
