The Supreme Court addressed the issue of whether an averment in a deed of gift regarding the handing over of possession constitutes sufficient proof of acceptance by the donee, under Sections 122 and 123 of the Transfer of Property Act. The Court held that the mere change of feelings by the donors does not invalidate the gift if the legal requirements are met, and thus, the cancellation of the gift deeds by the defendants was not justified. The Court reversed the High Court's decision, reinstating the Trial Court's decree in favor of the appellant.
