Judgment text excerpt

The Supreme Court held that under the Delhi Rent Control Act, the Karta of a Hindu Undivided Family (HUF) can file an eviction suit even when an elder member is alive, provided the Karta has the authority to act on behalf of the HUF. The Court affirmed the High Court's decision that the first appellate court had properly addressed all issues and re-evaluated evidence as per Order 41 Rule 31 of the CPC. The appeal was dismissed, upholding the eviction order against the appellant.
