The Supreme Court upheld the decision of the Allahabad High Court affirming the award of the Industrial Tribunal which declared that Kalyan Sharan, a daily wage employee since 1980, was entitled to be regularized as a Clerk due to continuous service since 1991. The Court emphasized that the employer's failure to regularize the employee constituted an unfair labor practice under the Uttar Pradesh (Krishi Evam Prodyogik Vishwavidyalaya Adhiniyam) Act, 1958. The Court held that the findings of the Labour Court were factual and warranted no interference, thereby dismissing the appeal.
