The Court found that the Appellate Tribunal correctly set aside the surrender of 11 acres and 07 guntas of land, as the respondent had been in continuous possession since 1971, and the surrender was not acceptable under Section 10(5)(a)(ii) due to the dispute over title. The Court affirmed that the High Court's ruling did not suffer from any infirmity and maintained the Appellate Tribunal's order regarding the land in question.
