Judgment text excerpt

The Supreme Court examined the appeal under Section 18 of the Telecom Regulatory Authority of India Act, 1997, challenging the TDSAT's decision which denied the Union of India's claim for a set off against a refund of Rs.50 crores to the respondent. The Court held that the TDSAT was justified in rejecting the counter claim as not maintainable and affirmed that the TDSAT had no jurisdiction to entertain such a counter claim. Consequently, the appeal was dismissed, upholding the TDSAT's order for the refund with interest.
