The Supreme Court held that the age of superannuation for employees of nationalized banks is governed by the regulations applicable at the time of their appointment and promotion. In this case, the Court found that Respondent No. 1, having been appointed prior to the nationalization of the bank and promoted thereafter, was entitled to retire at the age of 60 years as per Regulation 19 of the Service Regulations 1979, despite the age of superannuation being set at 58 years. The Court reversed the High Court's decision, affirming that Respondent No. 1 was entitled to continue in service until the age of 60 and directed the appellant Bank to pay the dues accordingly.
