The Supreme Court upheld the decision of the Delhi High Court which quashed the penalty of 10% deduction from the respondent's pension under Rule 43(d)(i) of the Central Reserve Police Force Rules, 1955. The Court found that the respondent's application for voluntary retirement was accepted, and thus, he was entitled to his retiral benefits. The Court held that the imposition of the penalty was unjustified and ordered reinstatement with all consequential benefits, including salary and pension.
