The Supreme Court interpreted Press Note No.12 dated 31.8.1998 under the Industries (Development and Regulation) Act, 1951, which mandates a minimum distance of 15 KMs between sugar mills to prevent unhealthy competition. The Court held that the Industrial Entrepreneur Memorandum (IEM) filed by M/s. Ojas Industries was valid, as it complied with the requirements set forth in the Press Note and the subsequent Notification dated 11.9.1998. The Court dismissed the challenge to the IEM filed by M/s. Oudh Sugar Mills Ltd., affirming the de-licensing policy of the sugar industry.
