The Supreme Court upheld the conviction of the appellant under Section 302/34 IPC for the murder of Kannu Shende, affirming the reliance on the testimonies of eyewitnesses P.W. 8 and P.W. 3 despite the latter turning hostile. The Court established that the presence of corroborative evidence, including the confession leading to the recovery of the murder weapon, justified the conviction. The appeal against the High Court's dismissal of the appellant's appeal was therefore rejected.
