The Supreme Court ruled that the Kerala Public Service Commission had the authority under Rule 13 of its Rules of Procedure to extend the validity of ranked lists during a ban on appointments, as per the amended 5th Proviso. The Court held that the failure to extend the ranked list for Overseer Grade-II, which expired on 31.3.2004, was improper given the circumstances of the ban. Consequently, the Court directed the Commission to include the appellants in the ranked list for appointment, thereby upholding the High Court's earlier decision to recast the list to include diploma holders.
